PLEASE READ THIS TERMS OF SERVICE AGREEMENT CAREFULLY, AS IT CONTAINS IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS AND REMEDIES.
1. OVERVIEW
This Terms of Service Agreement ("Agreement") is entered into by and between Field Epidemiology Network Europe, registered address Papiermolen 30, Netherlands ("Company", "we", "us", "our") and you, and is made effective as of the date of your use of this website https://portfolio.fieldepi.eu ("the Site") or the date of electronic acceptance.
This Agreement sets forth the general terms and conditions of your use of the Field Epidemiology Portfolio Platform as well as the portfolio services and features accessed through the Site (the "Services").
Whether you are simply browsing or using the Site or creating portfolio content, your use of the Site and your electronic acceptance of this Agreement signifies that you have read, understand, acknowledge and agree to be bound by this Agreement and our Privacy Statement. The terms "you", "your", "User" or "member" shall refer to any individual or entity who accepts this Agreement, uses our Site, has access to or uses the Services.
Important Notice: This Agreement works together with our main website Terms of Service at https://fieldepi.eu/terms-of-service/. Where there are differences, this Agreement takes precedence for portfolio platform use.
Company may, in its sole and absolute discretion, change or modify this Agreement, and any policies or agreements which are incorporated herein, at any time, and such changes or modifications shall be effective immediately upon posting to the Site. Your use of the Site or the Services after such changes or modifications have been made shall constitute your acceptance of this Agreement as last revised. Significant changes will be notified via email to registered users at least 30 days in advance.
IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT AS LAST REVISED, DO NOT USE (OR CONTINUE TO USE) THE SITE OR THE SERVICES.
2. ELIGIBILITY
The Site and the Services are available only to Users who can form legally binding contracts under applicable law.
By using the Site or the Services, you represent and warrant that you:
- (i) are at least eighteen (18) years of age,
- (ii) are otherwise recognized as being able to form legally binding contracts under applicable law,
- (iii) are not a person barred from using the Services under the laws of the Netherlands or other applicable jurisdiction, and
- (iv) are a professional working in or studying field epidemiology, public health, or related disciplines.
If you are entering into this Agreement on behalf of a company or any corporate entity, you represent and warrant that you have the legal authority to bind such corporate entity to the terms and conditions contained in this Agreement, in which case the terms "you", "your", "User" or "member" shall refer to such corporate entity. If, after your electronic acceptance of this Agreement, the Company finds that you do not have the legal authority to bind such corporate entity, you will be personally responsible for the obligations contained in this Agreement.
3. RULES OF USER CONDUCT
By using the Site You acknowledge and agree that:
Your use of the Site, including any content you submit, will comply with this Agreement and all applicable local, state, national and international laws, rules and regulations, including GDPR and Dutch data protection laws.
You will not use the Site in a manner that:
- Is illegal, or promotes or encourages illegal activity;
- Promotes, encourages or engages in child pornography or the exploitation of children;
- Promotes, encourages or engages in terrorism, violence against people, animals, or property;
- Promotes, encourages or engages in any spam or other unsolicited bulk email, or computer or network hacking or cracking;
- Infringes on the intellectual property rights of another User or any other person or entity;
- Violates the privacy or publicity rights of another User or any other person or entity, or breaches any duty of confidentiality that you owe to another User or any other person or entity;
- Violates professional ethics or research integrity standards applicable to field epidemiologists;
- Shares identifiable patient data or confidential public health information without proper consent and anonymization;
- Interferes with the operation of the Site;
- Contains or installs any viruses, worms, bugs, Trojan horses, cryptocurrency miners or other code, files or programs designed to, or capable of, disrupting, damaging, or limiting the functionality of any software or hardware.
You will not:
- Copy or distribute in any medium any part of the Site, except where expressly authorized by Company or where necessary for your legitimate portfolio use;
- Modify or alter any part of the Site or any of its related technologies;
- Access Site Content or User Content through any technology or means other than through the Site itself;
- Attempt to circumvent any content protection or access control mechanisms;
- Use automated systems (bots, scrapers) to access the Site without permission;
- Impersonate other users or falsify your professional credentials or affiliations.
4. INTELLECTUAL PROPERTY
Site Content: In addition to the general rules above, the provisions in this Section apply specifically to your use of Site Content posted to the Site. Site Content on the Site, including without limitation the text, software, scripts, source code, API, graphics, photos, sounds, music, videos and interactive features and the trademarks, service marks and logos contained therein ("Site Content"), are owned by or licensed to Field Epidemiology Network Europe and are subject to copyright, trademark, and/or patent protection under Dutch and EU law.
Site Content is provided to you "as is", "as available" and "with all faults" for your professional portfolio development use and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for commercial purposes without the express prior written consent of Company. No right or license under any copyright, trademark, patent or other proprietary right or license is granted by this Agreement beyond what is necessary for legitimate portfolio platform use.
Platform Software: The Mahara portfolio software is provided under the GNU General Public License v3.0. The FENE customizations, branding, and configurations remain the property of Field Epidemiology Network Europe.
5. YOUR PORTFOLIO CONTENT AND OWNERSHIP
Types of Content: The portfolio platform allows Users to create, post, publish, share, or manage:
- (a) Professional portfolios, reflections, and competency evidence ("Portfolio Content"),
- (b) Case studies, outbreak investigations, and field epidemiology work samples,
- (c) Photos, videos, documents, and other media ("User Content"),
- (d) Comments, feedback, and peer assessments on shared portfolios.
Your Ownership Rights: YOU RETAIN FULL OWNERSHIP of all Portfolio Content and User Content you create and upload. This is a fundamental principle of this portfolio platform.
By posting or publishing Portfolio Content or User Content to the Site, you represent and warrant that:
- (i) you have all necessary rights to distribute the content via the Site, either because you are the author or because you have appropriate licenses, consents, and/or permissions in writing;
- (ii) the content does not violate the rights of any third party;
- (iii) any patient data or confidential information has been properly anonymized and you have obtained necessary permissions;
- (iv) you have followed applicable research ethics and professional standards in creating the content;
- (v) the content is accurate to the best of your knowledge and does not contain false or misleading information.
Prohibited Content: You may not upload content that:
- Contains identifiable patient information without proper consent
- Violates confidentiality agreements or professional codes of conduct
- Infringes copyright, trademark, or other intellectual property rights
- Contains false credentials, fabricated data, or plagiarized work
- Is defamatory, harassing, discriminatory, or otherwise harmful
You agree not to circumvent, disable or otherwise interfere with the security-related features of the Site (including without limitation those features that prevent or restrict use or copying of any Site Content or User Content) or enforce limitations on the use of the Site.
6. LICENSE GRANT FOR PORTFOLIO PLATFORM USE
Non-Exclusive License from You to Us: By posting Portfolio Content or User Content to the Site, you grant Company a limited, non-exclusive, worldwide, royalty-free, sublicensable license to:
- Store, backup, and secure your content on our servers;
- Display your content to users you grant access to through your privacy settings;
- Process your content to provide portfolio services (e.g., generating exports, creating views);
- Use anonymized, aggregated data for platform improvement and analytics;
- Make temporary copies necessary for technical operations (caching, CDN distribution).
Important Limitations:
- This license is non-exclusive - you retain all rights to use, publish, and license your content elsewhere;
- This license is limited to platform operations - we will not use your content for marketing or commercial purposes without separate permission;
- This license respects your privacy settings - content marked private will only be accessed for technical operations, not viewed by staff;
- This license terminates when you delete content, except for:
- Technical backups (retained up to 30 days)
- Content others have legitimately copied or cited while it was shared
- Anonymized data used in aggregated analytics
Peer Sharing License: When you share Portfolio Content with other FENE members, you grant them a limited, non-exclusive license to:
- View and read your shared content;
- Provide feedback and peer assessment as permitted by platform features;
- Reference or cite your work in their own portfolios (with proper attribution);
- Download content you explicitly mark as downloadable.
This peer license does not grant rights to:
- Republish your content without permission;
- Claim your work as their own;
- Use your content for commercial purposes;
- Remove attribution or copyright notices.
Public Sharing: Content you mark as "Public" may be:
- Viewed by anyone, including search engines;
- Indexed by search engines;
- Cached by search engines and web archives;
Once content is made public, you cannot control how others may have copied or referenced it, though they remain bound by copyright law and must provide attribution.
7. PRIVACY SETTINGS AND SHARING CONTROL
You Control Access: The platform provides granular privacy controls. You can set content visibility to:
- Private: Only you can view
- FENE Members: All registered users can view
- Shared with Selected Users: Only specific people you choose
- Public: Anyone on the internet can view
Your Responsibilities:
- Review privacy settings before uploading sensitive content;
- Understand that shared content may be downloaded or cited by others;
- Regularly audit who has access to your portfolios;
- Report any unauthorized access or privacy breaches to legal@transmissible.eu.
Company's Obligations:
- We will honor your privacy settings in our operations;
- We will not view private content except for technical troubleshooting (with your permission) or legal requirements;
- We will notify you of any data breaches affecting your account within 72 hours as required by GDPR;
- We will provide tools to easily manage and update privacy settings.
8. CONTENT MODERATION AND REMOVAL
Our Right to Review: Company generally does not pre-screen Portfolio Content or User Content but reserves the right (but undertakes no duty) to review content and decide whether any item is appropriate and/or complies with this Agreement, professional standards, and applicable law.
We May Remove Content That:
- Violates this Agreement or our policies;
- Contains identifiable patient data without proper consent;
- Infringes intellectual property rights;
- Is illegal, harmful, or violates professional ethics;
- Poses security or privacy risks;
- Has been reported by users and confirmed to violate policies.
Process:
- We will notify you before removing content when possible;
- You may appeal content removal decisions within 14 days;
- Repeated violations may result in account suspension;
- We will provide reasons for content removal when requested.
Your Right to Delete: You may delete your own content at any time through the platform interface. Upon deletion:
- Content is removed from public view immediately;
- Content is removed from backups within 30 days;
- Legitimate copies made by others (while content was shared) remain their property;
- We retain anonymized metadata for analytics.
9. DATA PROTECTION AND GDPR COMPLIANCE
Legal Basis for Processing: We process your personal data based on:
- Consent: You provide consent when creating an account
- Contract: Processing necessary to provide portfolio services
- Legitimate Interest: Platform security and improvement
- Legal Obligation: Compliance with applicable laws
Your GDPR Rights: Under GDPR, you have the right to:
- Access: Request a copy of your data
- Rectification: Correct inaccurate data
- Erasure: Request deletion ("right to be forgotten")
- Portability: Receive your data in machine-readable format
- Restrict Processing: Limit how we use your data
- Object: Object to processing based on legitimate interests
- Withdraw Consent: At any time

Data Retention:
- Active accounts: Retained for duration of membership
- Inactive accounts: Deleted after 3 years of inactivity (you'll receive notice)
- Deleted accounts: Removed from backups within 30 days
- Legal compliance: Some data retained as required by law
Data Location: All data is stored on servers in Amsterdam, Netherlands (EU). We do not transfer personal data outside the European Economic Area.

10. LINKS TO THIRD-PARTY WEBSITES
The Site may contain links to third-party websites that are not owned or controlled by Company, including but not limited to:
Company assumes no responsibility for the content, terms and conditions, privacy policies, or practices of any third-party websites. In addition, Company does not censor or edit the content of any third-party websites. By using the Site you expressly release Company from any and all liability arising from your use of any third-party website. Accordingly, Company encourages you to review the terms and conditions, privacy policies, and other governing documents of each website that you visit.
11. PROFESSIONAL CONDUCT AND ETHICS
As a professional platform for field epidemiologists, you agree to:
Maintain Professional Standards:
- Follow applicable professional codes of conduct and ethics
- Maintain confidentiality of sensitive public health information
- Properly anonymize patient and location data in case studies
- Report disease outbreaks and public health threats through proper channels, not just via the platform
Academic and Research Integrity:
- Do not plagiarize or misrepresent others' work
- Provide proper citations and references
- Accurately represent your credentials, affiliations, and experience
- Disclose conflicts of interest when relevant
- Follow research ethics guidelines and obtain necessary approvals
Peer Review and Feedback:
- Provide constructive, professional feedback on shared portfolios
- Respect confidentiality when reviewing others' work
- Disclose potential conflicts when providing peer assessment
- Report ethical concerns or professional misconduct to legal@transmissible.eu
Violations of Professional Standards: Violations may result in:
- Content removal
- Loss of peer review privileges
- Account suspension or termination
- Reporting to relevant professional bodies if required
12. DISCLAIMER OF REPRESENTATIONS AND WARRANTIES
YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SITE SHALL BE AT YOUR OWN RISK AND THAT THE SITE IS PROVIDED "AS IS", "AS AVAILABLE" AND "WITH ALL FAULTS".
Company, its officers, directors, employees, and agents disclaim all warranties, statutory, express or implied, including, but not limited to, any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement.
Company makes no representations or warranties about:
- (i) The accuracy, completeness, or quality of portfolio content
- (ii) The accuracy, completeness, or content of any sites linked to the Site
- (iii) The continuous availability or error-free operation of the Services
- (iv) The professional qualifications or credentials of other users
- (v) The suitability of portfolio content for any particular purpose
Important Clarifications:
- Portfolio content represents users' personal work and views, not Company endorsements
- Peer feedback and assessments are opinions, not professional certifications
- Company does not verify the accuracy of case studies or outbreak investigations
- Users are responsible for ensuring their own professional compliance and competency
No Professional Advice: No oral or written information or advice provided by Company, its officers, directors, employees, or agents will:
- (i) Constitute professional, medical, or legal advice, or
- (ii) Create a warranty of any kind with respect to the Site or Services
Users should not rely solely on platform content for professional decisions.
THE FOREGOING DISCLAIMER SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW and shall survive any termination or expiration of this Agreement.
13. LIMITATION OF LIABILITY
IN NO EVENT SHALL COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND THIRD PARTY SERVICE PROVIDERS, BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING ANY DAMAGES THAT MAY RESULT FROM:
- (i) The accuracy, completeness, or content of the Site or portfolio content
- (ii) The accuracy, completeness, or content of any sites linked to the Site
- (iii) Personal injury or property damage of any nature whatsoever
- (iv) Third-party conduct of any nature whatsoever
- (v) Any interruption or cessation of Services
- (vi) Any viruses, worms, bugs, Trojan horses, or the like
- (vii) Any User Content or content that is defamatory, harassing, or otherwise objectionable
- (viii) Loss of portfolio data or content (you must maintain backups)
- (ix) Any loss or damage incurred as a result of your use of the Site
Maximum Liability: To the extent permitted by law, Company's total liability for all claims is limited to the greater of:
- €100, or
- The amount you paid for Services (if any) in the 12 months before the claim
Exceptions: This limitation does not apply to:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded by Dutch or EU law
- Willful misconduct or gross negligence
Time Limit for Claims: Any cause of action arising out of or related to the Site or Services must be commenced within one (1) year after the cause of action accrues, otherwise such cause of action shall be permanently barred.
THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW and shall survive any termination of this Agreement.
14. INDEMNITY
You agree to protect, defend, indemnify and hold harmless Company and its officers, directors, employees, and agents from and against any and all claims, demands, costs, expenses, losses, liabilities and damages of every kind and nature (including, without limitation, reasonable attorneys' fees) imposed upon or incurred by Company directly or indirectly arising from:
- (i) Your use of and access to the Site
- (ii) Your violation of any provision of this Agreement or incorporated policies
- (iii) Your violation of any third-party right, including intellectual property or privacy rights
- (iv) Your violation of professional ethics or research integrity standards
- (v) Your portfolio content or user content, including any claims of plagiarism, copyright infringement, or misrepresentation
- (vi) Harm caused by your sharing of identifiable patient data or confidential information
Process:
- You will cooperate with Company in defending such claims
- Company may assume exclusive defense at its own expense
- You may not settle any claim without Company's prior written consent
The indemnification obligations under this section shall survive any termination or expiration of this Agreement.
15. ACCOUNT TERMINATION AND SUSPENSION
Voluntary Closure: You may close your account at any time by:
Upon voluntary closure:
- Your access ends immediately
- Your data is retained for 30 days (for recovery if you change your mind)
- After 30 days, data is permanently deleted per our retention policy
- You may request immediate deletion by contacting us
Involuntary Termination: We may suspend or terminate accounts that:
- Violate this Agreement or our policies
- Remain inactive for more than 3 years (with prior notice)
- Are used for fraudulent, illegal, or harmful purposes
- Repeatedly violate professional standards
- Pose security risks to the platform or other users
- Are subject to legal orders requiring termination
Notice and Appeal:
- We will provide 30 days' notice before terminating accounts for policy violations (except serious violations)
- You may appeal termination decisions within 14 days by emailing legal@transmissible.eu
- We will review appeals and respond within 30 days
- During appeals, access may remain suspended
Effects of Termination:
- Immediate loss of access to the platform
- Content becomes inaccessible to you and others
- Content you shared may remain in others' portfolios (as legitimately copied)
- Data retention follows our standard policies (see Privacy Statement)
16. DATA TRANSFER AND INTERNATIONAL USE
Server Location: All data is stored on servers located in Amsterdam, Netherlands (European Union).
No International Transfers: We do not transfer personal data outside the European Economic Area. All processing occurs within the EU in compliance with GDPR.
International Users: If you are accessing the Site from outside the EU:
- Your data will be transferred to and stored in the EU
- You consent to this transfer and to processing under EU data protection laws
- EU data protection standards will apply to your data
- You retain all GDPR rights regardless of your location
17. AVAILABILITY OF WEBSITE
Subject to the terms and conditions of this Agreement and our policies, we shall use commercially reasonable efforts to provide the Site on a 24/7 basis.
You acknowledge and agree that:
- The Site may be inaccessible for periodic maintenance, repairs, or replacements
- Interruptions may occur due to causes beyond our control (network failures, cyber attacks, etc.)
- We have no control over continuous or uninterrupted availability
- We assume no liability for unavailability or interruptions
- We will provide notice of planned maintenance when possible
- Emergency maintenance may occur without notice
Backup Responsibility: You are responsible for maintaining your own backups of important portfolio content. Use the export features regularly.
18. DISCONTINUED SERVICES
Company reserves the right to cease offering or providing any of the Services at any time, for any or no reason, with reasonable notice.
If Services are Discontinued:
- We will provide at least 90 days' notice to active users
- You will have time to export your portfolio data
- We will offer data export tools in common formats
- We will honor data retention and deletion commitments
Company will not be liable to you or any third party for any modification, suspension, or discontinuance of Services, provided reasonable notice and data export opportunity are given.
19. FEES AND PAYMENTS
Current Policy: The Field Epidemiology Portfolio Platform is currently provided free of charge to FENE members.
Future Changes: If fees are introduced in the future:
- Existing users will receive at least 90 days' notice
- You will have the option to close your account before fees apply
- Clear pricing will be provided
- Any fees will be charged by Field Epidemiology Network Europe
- Fees may be subject to VAT or other applicable taxes
Refund Policy: If fees are charged:
- Refunds will be considered on a case-by-case basis
- Refund requests must be made within 30 days
- No refunds for partial subscription periods unless service is unavailable
20. COOKIES AND TRACKING
Cookie Use: We use cookies for:
- Essential: Login sessions, security (required)
- Functional: User preferences, language settings (optional)
- Analytics: Platform usage statistics (optional, requires consent)
Your Cookie Choices:
- Essential cookies cannot be disabled (required for platform function)
- You can manage optional cookies in your account settings
- You can control cookies via browser settings

21. MODIFICATIONS TO THE PLATFORM
We Reserve the Right to:
- Add, modify, or remove features
- Change the design or layout
- Update or improve functionality
- Fix bugs and security issues
Significant Changes:
- Will be announced via email or platform notification
- Will include transition guidance when major features change
- Will provide reasonable time to adapt to changes
22. GOVERNING LAW
This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the laws of the Netherlands, to the exclusion of conflict of law rules.
EU Consumer Protection: Nothing in this Agreement affects your statutory rights as a consumer under EU law, including:
- Right to cancel distance contracts within 14 days
- Right to conforming goods and services
- Protection against unfair contract terms
23. DISPUTE RESOLUTION
Informal Resolution First: Before initiating any formal proceedings, you agree to first contact us at legal@transmissible.eu to attempt to resolve any disputes informally. We will respond within 14 days and work in good faith to resolve the issue.
EU Consumers: If you are an EU consumer, you have the right to:
- Bring disputes before the courts of your place of residence
- Use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
- Lodge complaints with consumer protection authorities
Business Users: For business users or non-consumer disputes:
- Disputes shall be subject to the exclusive jurisdiction of the courts of Amsterdam, Netherlands
- Mediation may be attempted before litigation
Class Action Waiver: To the extent permitted by law, disputes must be brought individually, not as part of a class action.
24. NO THIRD-PARTY BENEFICIARIES
Nothing in this Agreement shall be deemed to confer any third-party rights or benefits, except:
- Rights of other FENE members to access content you share with them
- Rights of individuals whose data you process (under GDPR)
25. SEVERABILITY
Each covenant and agreement in this Agreement shall be construed for all purposes to be a separate and independent covenant or agreement.
If a court of competent jurisdiction holds any provision (or portion of a provision) of this Agreement to be illegal, invalid, or otherwise unenforceable:
- The remaining provisions shall not be affected
- The invalid provision shall be modified to the minimum extent necessary to make it enforceable
- If modification is not possible, the provision shall be severed
- The remainder of the Agreement shall remain in full force and effect
26. ENTIRE AGREEMENT
This Agreement, together with our Privacy Statement and any other policies incorporated by reference, constitutes the entire agreement between you and Company regarding use of the Site and Services.
This Agreement supersedes any prior agreements or understandings, whether written or oral.

27. NO WAIVER
Our failure to enforce any right or provision of this Agreement does not constitute a waiver of that right or provision.
Any waiver must be in writing and signed by an authorized Company representative.
No waiver of any breach shall be deemed a waiver of any subsequent breach.
28. ASSIGNMENT
You May Not Assign: You may not assign or transfer this Agreement or any rights hereunder without Company's prior written consent.
We May Assign: Company may assign this Agreement or any rights hereunder to:
- An affiliate or subsidiary
- A successor entity in a merger or acquisition
- Any party in connection with a sale of assets
Any attempted assignment in violation of this section is void.
29. NOTICES
To You: We will provide notices to you via:
- Email to your registered email address
- Platform notification upon login
- Notice posted on the Site
You are responsible for keeping your email address current.
To Us: You may provide notice to us at:
Notices are effective when received.
30. LANGUAGE
This Agreement is written in English. If this Agreement is translated into other languages, the English version shall prevail in case of any inconsistency or dispute.
31. SURVIVAL
The following provisions shall survive termination or expiration of this Agreement:
- Intellectual Property (Section 4)
- Content Ownership provisions (Section 5)
- License grants for content already shared (Section 6)
- Data Protection obligations (Section 9)
- Disclaimer of Warranties (Section 12)
- Limitation of Liability (Section 13)
- Indemnification (Section 14)
- Governing Law (Section 22)
- Dispute Resolution (Section 23)

33. ACKNOWLEDGMENT
